We are a Limited Liability Company, Eastern Motor Company Limited Trading as Car Loan Shop and our registered office is 27a Norman Spenser Drive Manukau City. You Agree, to be bound by, and act in accordance with these Terms & Conditions, as well as our Privacy Policy by accessing and using this website. If you do not wish to be bound by these Terms and Conditions then you should not use or access our site.

Car Loan Shop has endeavoured to ensure that all information on our site is accurate and helpful, however, the information is general in nature and only intended as a guide to the types of Products & Services Car Loan Shop offer. Car Loan Shop and Potential Lenders, Insurers, Service Providers, Vehicle Suppliers and agents will use your personal details and information we obtain from other sources to deal with your enquiries, consider your application, including Carrying out Credit
reports, Drivers License details and any other information required for dealing with your enquiry.

We, and third party lenders, insurers, service providers and agents may contact you by mail, telephone, email or by any other means as required to gain further information and offer products and services that may be of interest to you. By providing us with
your contact details, you hereby agree to being contacted by the methods and for the purposes set out in, and in accordance with our Privacy Policy. In assessing your finance application, you consent to us disclosing details of your application to Third Party
lenders and completing credit checks as when and where required. If you give us false or misleading information and fraud is identified, we are required by law to pass this information to Fraud Prevention Agencies.

CREDIT GUIDE:

A Credit guide sets out important information about the services we provide as a broker, any Fees and Commission payable to us, as well as our responsible lending obligations and our dispute resolution procedures.

Car Loan Shop provides credit assistance when we assist you to apply for credit, or increase your credit limit. We also provide assistance with suggesting Insurance products for your protection.

Which Providers do we utilise when providing Credit assistance?
We provide credit products from a number of banks, lenders, other credit providers and Insurance providers.

  • Marac Insurance

Fees for credit assistance depends on the extent of work we need to do on your behalf. The exact amount will be clearly disclosed to you verbally and in the paperwork prior to you accepting the credit/finance offered.

Prior to providing credit assistance, we are required to complete a preliminary assessment – your requirements and objectives for seeking a credit product, insurance product, your financial & personal situation. We maintain a record of your personal profile including details gathered, which you can request a copy of at any time.

Are commissions, fees or other benefits paid to All Go Finance by the credit and insurance providers?
Fees and Commissions are only received should you take up the credit proposal. We receive the Brokerage Commissions, Insurance Commission and Finance Commission based on the volume of business.
We can provide a breakdown of these commissions, fees and benefits and how they are calculated by request.

Car Loan Shop are here to assist you to reach an informed decision as to whether or not you decide to enter into the contract and to aware of the full implications of entering into the contract, and we ensure that no information is misleading, deceptive or confusing.

When is a credit contract unsuitable?
A credit contract will be unsuitable if:

  • It is likely that you will be unable to comply with the financial obligations under the credit contract; or
  • It is likely that you could only comply with the financial obligations with substantial hardship (such as having to sell your principal place of residence); or
  • It is likely that the credit contract will not meet your stated requirements or objectives; or
  • The insurance products provided under the contract do not meet your requirements and objectives
  • If you are required to take out income-protection insurance and the credit provider knew that you were unemployed; or
  • If you were required to take our insurance for goods bought on credit and the credit provider reasonably ought to have known you already had contents insurance that would cover the goods; or
  • You were sold a warranty that simply duplicates the manufacturer’s warranty, such as a 12 month warranty on goods that have an 18 month manufacturer’s warranty.

We want to ensure that the credit products you select with us are suitable for your needs. It is important that you openly and honestly discuss with us your requirements, objectives, preferences, financial situation and repayment capacity.

Sometimes a credit provider won’t provide credit unless you buy one or all of these products, however a credit provider can’t require you to buy credit related insurance, extended warranties or repayment Insurance, if it it is not reasonable in the circumstances. Buying any of these services is your choice.

Depending on your circumstances it may be unreasonable for a credit provider, or insurance provider to sell these services. In this case you and the credit provider have to make a choice.

The credit provider can provide credit (without the protections these services would provide) or not give the credit at all. If the credit provider extends the credit, then they may modify the original terms. This may involve reducing the credit limit, increasing the interest rate on the credit proposal, or both. Credit providers don’t have to give credit to everybody – they can choose who to lend to and who not to lend to.

If you have a complaint or concern about the service provided to you by us, please contact our Complaints Resolution Manager. As part of the Internal Dispute Resolution policy they will investigate the matter and endeavour to address it as quickly as possible.
